1. Acceptance of Terms

By accessing or using Kcaly (“the Service”), operated at kcaly.ai, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Service Description

Kcaly is an AI-powered nutrition tracking service. You send photos, text descriptions, or voice messages of your meals via WhatsApp, and our AI analyzes the nutritional content (calories, protein, fat, carbs). The Service includes:

• AI meal analysis via WhatsApp
• Web-based nutrition dashboard and analytics
• Personalized goal tracking
• AI-generated meal plan suggestions
• Optional coaching features

3. Account & Authentication

You must provide a valid phone number to create an account. Authentication is handled via WhatsApp OTP (one-time password). You are responsible for:

• Maintaining the security of your phone number and authentication
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

You must be at least 16 years old to use the Service.

4. Subscription & Payment

Kcaly costs $5 per month. Payment is processed by Paddle (our Merchant of Record).

• Subscriptions renew automatically each month until cancelled
• You can cancel at any time from your account settings — no cancellation fees
• Upon cancellation, you retain access until the end of your current billing period
• Refunds are handled on a case-by-case basis — contact us for refund requests
• Paddle handles all billing, invoicing, and tax compliance as the Merchant of Record

5. WhatsApp Usage

The Service operates through the WhatsApp Business API. By using Kcaly, you acknowledge that:

• Messages sent to our bot are processed by our AI and stored for the Service
• WhatsApp's own Terms of Service and Privacy Policy also apply to your messages
• We are not responsible for WhatsApp service disruptions or changes
• You should not send sensitive medical, financial, or personal information beyond what is needed for nutrition tracking

6. User Content

You retain ownership of all content you submit (meal photos, descriptions, etc.). By using the Service, you grant Kcaly a non-exclusive, worldwide license to process and analyze your content for the purpose of providing the Service.

You agree not to:

• Use the Service for any unlawful purpose
• Submit content that infringes on others' rights
• Attempt to reverse-engineer, hack, or disrupt the Service
• Use automated tools to scrape or abuse the Service

7. Medical Disclaimer

Kcaly is not a medical service. The nutritional information provided is generated by AI and should be treated as estimates only. Kcaly does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making significant dietary changes, especially if you have medical conditions, allergies, or eating disorders.

8. Limitation of Liability

To the maximum extent permitted by law, Kcaly and its operators shall not be liable for:

• Inaccuracies in AI-generated nutritional analysis
• Health consequences resulting from following nutritional information
• Service interruptions, data loss, or technical failures
• Any indirect, incidental, special, or consequential damages

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

You may stop using the Service and cancel your subscription at any time. We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in abusive or fraudulent behavior
• Fail to maintain an active subscription (after grace period)

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
